POSITION SUMMARY:  The position is responsible for managing Litigation Specialists, and the Liability Claims Staff in the resolution of litigated and disputed claims arising out of hurricanes, other property and liability losses, both personal lines and commercial lines, to ensure attainment of objectives, productivity, adherence to company policies and procedures and fulfillment of customer service expectations.  The Claims Manager leads a team of file handlers overseeing claims pending principally in the litigation process and non litigated liability claims.  This position mandates successful completion of all requirements of Fundamental Claims School, which includes obtaining an overall passing score. 

ESSENTIAL FUNCTIONS: THE FOLLOWING ARE THE USUAL, BASIC AND ESSENTIAL FUNCTIONS OF THE POSITION.  THESE FUNCTIONS ARE NOT TO BE CONSTRUED AS AN EXHAUSTIVE LIST OF ALL RESPONSIBILITIES, DUTIES, AND SKILLS REQUIRED.

• Manages the satisfactory resolution of claims, both non-disputed and disputed claims, through the casualty claim and litigation units.
• Responsible for personnel management which includes training, development, counseling and performance evaluations.
• Evaluates claims and addresses policy coverage issues in excess of staff authority.
• Effectively and proactively manages staffing and budgets.
• Resolves disputed and non-disputed claims directly and through management of others, to include:                                                                              
        o Ensuring proper claim handling and compliance with procedures, laws, rules, and regulations.
        o Evaluating property and liability claims and providing guidance and settlement authority to others. 
        o Conducting case reviews, and preparing settlement evaluations.
        o Effectively managing loss, loss adjustment expense and loss reserves for property and liability claims.
        o Analyzing reports to identify trends and proposing appropriate interventions.
        o Recognizing complex claims and as appropriate: elevating;  seeking legal, roundtable and/or peer review; and developing claims strategy and settlement solutions.
        o Participating in training and mentoring of external business partners and internal staff.
• Assists senior management with creation of strategic initiatives and implementation of core claims handling processes
• Directly handles large and/or complex cases.
• Determines and negotiates claim values by applying, analyzing and interpreting policy language, legal principles and using sound judgment.
• Keeps current on industry activity and legal trends and reports to upper management.
• Conducts Open and Closed File Reviews to evaluate and document overall operational value.
• Develops and analyzes statistical reports.
• Develops and maintains files on expert resources, engineers, and defense attorneys.
• Provides the Claims Director claims-related information as it relates to the financial impact of the Company.

REQUIRED KNOWLEDGE, SKILLS AND ABILITIES:
• Strong planning and organizational skills
• Strong leadership and managerial skills
• Strong verbal and written communication skills
• Comprehensive knowledge of property claims practices and legal terminology
• Strong analytical and negotiation skills
• Ability to manage budgets
• Computer literacy in Microsoft Word, Excel and Outlook.

REQUIRED EDUCATION AND EXPERIENCE:
• Bachelor's degree in Business Administration or related field with skills transferable to insurance; OR equivalent combination of four years in college education and/or transferable experience. 
• Active Florida Adjuster license (620) - Appointment Required within 6 months of employment.
• Five years of experience in either Personal or Commercial Property Claims adjusting, to include experience in Alternate Dispute Resolution (i.e. appraisal, mediation and litigation claims).
• At least two years supervisory/managerial experience, to include Alternative Dispute Resolution.
• Within 90 days of employment, must successfully complete all requirements of Citizens Fundamental Claims School which includes obtaining an overall passing score.
• Prior experience with computerized estimating programs.


PREFERRED QUALIFICATIONS:
• Prior experience with Xactimate.
• Prior experience with Litigation Management software systems.
• At least eight years of experience in either Personal or Commercial Property & Liability Claims adjusting, to include Alternative Dispute Resolution.
• Five years supervisory/managerial experience, to include Alternative Dispute Resolution.

PHYSICAL REQUIREMENTS:
This position requires the ability to sit for long periods of time, hear and converse over the telephone, and key frequently on a computer.  Ability to be mobile, operate a motor vehicle, climb roofs and work in a highly energetic and flexible work environment.
