SUMMARY: Directly manage claims arising out of commercial surety bonds including the management of all resources necessary to investigate and manage claims. Provide legal advice and/or analysis of complex/large loss commercial surety bond obligations to Home Office and underwriting departments in Field Offices.
PRIMARY DUTIES: Investigation and/or analysis of ERISA Bond claims and a variety of commercial surety claims including, but not limited to, claims filed on Court Bonds, License and Permit Bonds, and Notary Bonds.
Prepare and/or assist in the preparation of internal reporting tools such as Quarterly Large Loss Reports and Litigation reports. Responsible for reporting on assigned matters to management as well as compliance with all reporting requirements. Accurately reserve losses and expenses within accident year.
Review and manage litigation on assigned matters including, but not limited to, development of litigation and resolution strategies, management and monitoring of outside counsel. Manage, monitor and assist outside counsel on extra contractual suits against the company and testify at trials and depositions. Assure compliance with litigation management plans; timely and pro-active case involvement, audit legal bills for compliance with company retention policies and litigation budgets, monitor the quality of outside legal services and recommend use or discontinued use of outside legal counsel.
Conduct or coordinate legal research on issues relative to surety litigation and/or investigation.
EDUCATION/COURSE OF STUDY: Juris Doctor degree from an accredited law school and a membership in good standing of the bar of at least one jurisdiction
WORK EXPERIENCE: 3-5 years of litigation, other relevant legal experience or construction law or surety law experience. 5 years legal experience preferred, including previous supervisory experience.
COMMUNICATION SKILLS: Excellent organizational and communication skills.
COMPUTER SKILLS: Spreadsheet and word processing skills required as well as use of company claim and underwriting systems
OTHER: Demonstrated ability to perform the legal investigation and/or analysis of complex surety bond obligations, and to perform the primary duties and responsibilities set forth above. Conducts or coordinates legal research, ability to analyze and/or identify complex legal issues. Investigative and negotiation skills, ability to read and interpret contracts.
